Fences located in front setbacks cannot exceed the maximum height of 42in. Fences located in the rear and side setbacks cannot exceed the maximum height of 6ft in residential and commercial zoning districts and 8ft in industrial zoning districts. Fences in the setback areas abutting or adjacent to the waterfront of Newport Bay, the shoreline of the Pacific Ocean, the Old Channel of the Santa River (the Oxbow Loop), or the channels in West Newport cannot exceed 42in from the existing grade prior to construction.
